Baldwin County Commission Meeting – July 5, 2023


Proposed RSA Development at Lakewood Golf Course Denied

RSA (Retirement Systems of Alabama) sought to re-zone 7.2 acres of undeveloped land between the existing fairways of the Lakewood Golf Course.The property is located south of Battles Rd. and East of Scenic Hwy. 98 in Fairhope.RSA sought to re-zone the property from OR (Outdoor Recreation) to RSF-1 (Residential Single Family) for a proposed 6-lot custom residential subdivision.The Planning Commission heard the request at their May meeting and voted 4-3 to send a denial recommendation to the Baldwin County Commission. There were concerns over the safety of the location from wayward golf balls, and safety of the roadway access.After the May Planning Commission meeting RSA amended their plans to increase the width of the roadway. The plans called for saving all the live oaks on the site, with the removal of two pine trees.The Baldwin County Commission heard arguments on both sides during the public hearing, including expert testimony about the impact of wayward golf balls, and golf course design standards.After the public hearing the Baldwin County Commission voted unanimously to deny the request for re-zoning and the Planned Residential Development (PRD).

Fairhope Planning Commission Meeting – July 6, 2023


Clinic Office Site Approved

The Fairhope Planning Commission approved the MOP (Multiple Occupancy Project) request from Venner, LLC.The approval will allow a 4-unit clinic/office project.The .6-acre site is located on the south side of Spring Run Dr., just east of South Greeno Rd.The lot is currently undeveloped and surrounded by office and residential uses.Plans for the site include two 1,732 sf buildings with two units each with a total of 18 parking spaces.An uncovered courtyard area will separate the two buildings.

Baldwin County Planning Commission Meeting– July 6, 2023


Bella Serra Gardens Conditional Use Permit Revoked

The Baldwin County Planning Commission again considered the Conditional Use Permit (CUP) for Bella Serra Gardens. The wedding venue and event center is located along County Rd. 49 in the Loxley area. It is zoned RSF-E. The CUP that allows the operation of the venue has come under scrutiny due to noise complaints from neighboring residents. A proposal which would have allowed the CUP to continue with additional conditions and penalties was rejected by the Planning Commission. Instead, the Planning Commission voted to revoke the CUP. Under the terms of the revocation Bella Serra was given 30 days to provide a list of its current commitments and reservations, which will be allowed to continue. When all commitments are finished the CUP will stop completely. Bella Serra will not be allowed to book additional commitments.

199-Lot Subdivision Planned Northwest of Silverhill

Approval was granted by the Baldwin County Planning Commission for the subdivision of 79 acres.The property is located west of County Rd. 49 and a quarter mile north of Hwy. 104, northwest of the Town of Silverhill.The citizens of this planning district recently voted to come into zoning, but this subdivision application preceded the vote.Therefore, it was reviewed as un-zoned property.Plans include the development of a 199-lot residential subdivision.A traffic study recommended a westbound left turn lane at the intersection of County Rd. 54 and County Rd. 49.The development is to be named Silver Springs.

284-Lot Iron Horse Subdivision Approved Near Summerdale

The Baldwin County Commission approved the subdivision of a 96-acre tract located north of County Road 24 and east of County Road 65, between Summerdale and Foley. The property is un-zoned. There are 284 residential lots planned for the property to be completed in two phases. Two vehicular access points are planned for County Road 65 and Underwood Rd. The development is to be named Iron Horse.

Chapel Addition Approved for Little Point Clear Venue

The Baldwin County Planning Commission approved the site plan for The Chapel at Little Point Clear.The Chapel will be an addition to the existing event venue located on the adjacent property along the west side of Scenic Hwy. 98, just south of Battles Rd. in Fairhope.The property is zoned B-2.The Chapel will seat approximately 56 guests and will be used as a small wedding venue.The existing structure will be demolished for construction of The Chapel and rear parking area.The approval was conditioned upon the person count not exceeding a total of 125 persons at one time between Little Point Clear and The Chapel.

Orange Beach Planning Commission Meeting – July 10, 2023


Phoenix South Point Condominium Approved

The Orange Beach Planning Commission approved the site plan for Phoenix South Point. The property is located beachside at 25610 Perdido Beach Blvd. Plans include the construction of a 22-story condominium tower that would house 66 condo units. The site is zoned BR-2 (Beach Resort High Density). Back in 2020 the Planning Commission approved a previous site plan on the same location for Atlas Condominium, a 13-story development with 38 units. Those plans never materialized.


New Building for Beach Getaways Approved

The Orange Beach Planning Commission approved the site plan to construct a 5,000 square foot commercial building for Beach Getaways operations. The property is located at 24420 Canal Rd. The property is zoned GB (General Business).



Orange Beach City Council Meeting – July 11, 2023


Phoenix West II Adding Guest Amenities

The Orange Beach City Council approved a PUD modification request from the Phoenix West II located at 23450 Perdido Beach Blvd.The modification would call for the addition of a restaurant and bar area, with a grilling pavilion.The restaurant, with a floor area of 4,200 square feet, would be located on the ground level around the pool deck.The restaurant is planned to include a covered area and open terraces on the south and east sides.There will also be a beach supply store and souvenir shop located under the covered floor area. The added amenities will only be available for guests.

Baldwin County Commission Meeting – July 18, 2023


County Commission Approves Master Plan

The Baldwin County Commission approved the County Master Plan – A Citizen’s Guide to Growth in the Zoned Areas of Baldwin County. The Plan has been the subject of many public input and stakeholder meetings. The Guide is not a regulatory document and does not create any new regulations. It is to be used as a reference tool when reviewing rezoning requests in zoned areas. The Guide can be read in its entirety here.



Foley Planning Commission Meeting – July 19, 2023


Collins Aerospace Expanding

The Foley Planning Commission approved a site plan request from Collins Aerospace. The property is located at 1300 W. Fern Ave., on the west side of the existing building. The proposed addition will add 95,000 square feet of manufacturing and assembly space. The entire property is over 80 acres.


Site Plan Approved for Machinery Rental Facility

The Foley Planning Commission approved a site plan request from Empower Rental Group. The property is located east of the Foley Beach Express and south of the Industrial Pkwy. The 4-acre site is planned to house a rental facility for heavy machinery and equipment.


Go-Cart Track Approved in Foley

The Foley Planning Commission gave site plan approval for the Creekside International Speedway. The 2.9-acre development will be located south of County Rd. 20 and west of James Rd. The business will operate electric go-carts, bumper cars, batting cages, etc.



Gulf Shores City Council Meeting – July 24, 2023


Vacation Rental Request Approved

The Gulf Shores City Council approved the Conditional Use Permit (CUP) for property located at 324 E. 24th Ave. the CUP will allow the single-family home currently on the property to be re-purposed as a vacation rental. The property is zoned R-4 and within the Waterway Village Overlay District, therefore must have a CUP to operate as a vacation rental.

Gulf Shores Approves Annexation Requests

The Gulf Shores City Council approved the following annexation requests from property owners:

  • .62 undeveloped acres at 4322 County Rd. 6

  • .61 acres at 4344 County Rd. 6 with a single-family home

  • .66 acres at 9146 Pine Acres Rd. with a single-family home

All properties will automatically be zoned R-1-4.



Gulf Shores Planning Commission Meeting – July 25, 2023


Seven-Acre Mixed-Use Development Planned for ICW South Dist.

The Gulf Shores Planning Commission granted a request from 24 Canal Place for a PUD Master Plan.The 7.2-acre site is located on the south waterfront of the Intracoastal Waterway and extends east and west of the Hwy. 59 bridge.Developers are proposing a mixed-use design that would include shopping, residential, dining, and entertainment with transient boat docking areas.A density of 20 dwelling units per acre and 6 stories in height is requested under the master plan PUD.
