Fairhope Planning Commission Meeting – February 3, 2025


Orthodontist Office Planned for Encounter Commercial Development

The Fairhope Planning Commission granted site plan approval for Harvey and Thomas Orthodontics to be located on Lot 9 of the Encounter Development located northeast of the intersection of Hwy. 181 and Hwy. 104.  The 1-acre property is zoned B-2 and will house an 8,200 square foot commercial building for use as a dental and orthodontic office.


Foosackly’s Planned for Encounter Commercial Development

A new Foosackly’s restaurant is planned for Lot 4 of the Encounter Commercial Development located northeast of the intersection of Hwy. 104 and Hwy. 181 in Fairhope.  The 1.5-acre property is zoned B-2.  The 5,874 SF Foosackly’s building will be complemented by a 1,178 SF Just Chillin ice cream stand on the same site. 


Point Clear Development Tabled

The Fairhope Planning Commission heard a preliminary plat request from PCH Hotels and Resorts/RSA, which owns 22.4 acres located on the north side of Battles Road on the east and west sides of Colony Dr.  The developers are requesting approval of Battles Trace Phase 9, which would add 81 single family residential lots.  The property is within the TR (Tourist Resort) zoning district, which has its own separate guidelines specific to that district. The Planning Commission heard numerous complaints from nearby residents during the public hearing. Complaints were mainly focused on the loss of trees and clear cutting and adding to the density and traffic of the area.  The matter was tabled until the next meeting for the city horticulturist to meet with the developer and review the plans.


Windrow Subdivision Recommended for Approval

The Fairhope Planning Commission voted to approve the preliminary plat for Windrow Subdivision.  The R-1 zoned property is located east of Section St. between Twin Beech Rd. and Brodbeck Lane, across from Hilltop Subdivision.  There are 21 single family residential lots planned for the 17.7 acre site.

Baldwin County Planning Commission Meeting – February 6, 2025


Nine-Lot Subdivision Approved Near Lilliam

The Baldwin County Planning Commission approved the subdivision of 6.9 acres located east of County Road 93 just north of Highway 98, near the Lillian community.  The property will be divided into 9 single family lots with four common driveways.  The lots are zoned RSF-2 with the smallest lot being 15,000 square feet.

Casitas Added to Two Lakes RV Park

The Baldwin County Planning Commission approved the Planned Residential Development request for a 114-unit RV Park.  The 40-acre site is located on the west side of Roscoe Road, just north of Bradford Road.  The site is currently zoned RV and Phase I was previously approved two years ago.  Now the applicant is modifying the site plan to add casitas.  The casita living quarters can be used in conjunction with the RV.  The individual owners will have the option to build a casita.  An RV must be present to use the casita.

Townhome Development Approved Near Loxley

The Baldwin County Planning Commission approved the site plan for Cottages on 31.  The 29-unit townhome development is to be located west of U.S. Hwy. 31 and south of Bromley Road.  The 6.6-acre site is un-zoned.

 

193-Lot Subdivision Planned South of Robertsdale

The Baldwin County Planning Commission approved the preliminary plat for Southtown Phase II, a 193-lot single family residential subdivision.  The 80-acre property is located south of County Road 48 and west of Hwy. 59, south of Robertsdale.  Phase I of the development was approved in 2006 before the project went defunct. Some of the existing infrastructure remains in Phase II.

Fairhope City Council Meeting – February 10, 2025


Fairhope Enacts Development Moratorium

The Fairhope City Council voted to approve a nine month moratorium on new applications for residential multiple occupancy projects and residential subdivisions with three or more lots less than 10,500 square feet.  Commercial development is not affected by the moratorium.  The City Council cited the need to protect the health, safety, and general welfare of the public and the need for further infrastructure studies as reasons for the action.  Growth has put burdens on city infrastructure and there are plans underway now for additional water well and wastewater upgrades and capacity studies.

Margaritaville Waterfront Dist. Moves Forward with Site Plan

The Orange Beach Planning Commission voted to approve the subdivision of 108 acres into six lots for the future Margaritaville development.  The General Business-zoned property is located at 22960 Brown Lane, east of the Foley Beach Express.  The site plan for Lots 2 and 4 was also approved.  Plans include a mixed-use resort with a six-story multi-use building containing 100 condo-hotel units, 49 condominium units, and over 76,000 SF of lobby and commercial space.  The resort will also include 43 transient boat slips.

Bear Point Subdivision Approved

The Orange Beach Planning Commission approved the preliminary major subdivision request to subdivide property located on the north side of Canal Rd. at the northeast corner of the intersection of Canal Rd. and Avenue C.  A total of seven lots will be created from the division.

Spanish Fort City Council Meeting – February 17, 2025


Storage Shed Sales Regulated in Spanish Fort

The Spanish Fort City Council passed an amendment to the zoning ordinance that will restrict the display and sale of portable storage sheds.  The sale and display of storage sheds would be allowed by right in M-1 zoning district and only allowed with Planning Commission approval in B-3 and B-4.  The Amendment also restricts the number of sheds based on the size of the property. 


Commercial Re-Zoning Approved

The Spanish Fort City Council approved the re-zoning of property located at 10284 U.S. Highway 31.  The re-zoning will change the classification from R-1 to B-1.  The corner property is across from the Rockwell School and just west of the Mapco gas station.  No plans were publicly disclosed for the property.

 


Baldwin County Commission Meeting – February 18, 2025


Re-Zoning Denied for Property Northwest of Gulf Shores

The Baldwin County Commission voted to deny a re-zoning request for a large parcel of land located northwest of Gulf Shores.  The 114-acre property is located south on County Road 12S and east of Norris Lane.  The current use of the property is for agriculture.  Developers had requested to change the zoning from RA and RR to RSF-2 for single-family use. 


Re-Zoning Approved North of Foley Beach Express

The Baldwin County Commission voted to approve the re-zoning of 40 acres located north of the Foley Beach express and west of Roscoe Road.  The property zoning will change from RA to RSF-2 for future residential development.

                                   

Hwy. 104 Re-Zoning Approved

The Baldwin County Commission voted to grant final approval for the re-zoning of 31 acres from BCZ (Base Community Zoning) to B-2 and RSF-2.  The property is located on the north side of Hwy. 104 and east of St. Michaels Way, approximately one mile east of the intersection of Hwy. 104 and 181, northeast of Fairhope.  The property is currently vacant.  The southern 10 acres are proposed for commercial development, and the northern 21.7 acres are slated for residential development.  There were no specific plans revealed.  Residents from the nearby Verandas neighborhood had voiced opposition.

 


Daphne Planning Commission Meeting – February 27, 2025


Preliminary Plats Approved for The Reserve at Daphne Phases 4 & 5

The Daphne Planning Commission approved the preliminary plat applications for Phases 4 and 5 of The Reserve at Daphne.  The property is located north of the intersection of Montelucia Way and Evensong Drive.  Phase 4 will include 82 lots on 42 acres.  Phase 5 will add 66 lots on 33 acres.  The property is zoned R-6(G) and R-2.


Belforest Area Property Zoning Change Recommended

The Daphne Planning Commission voted to send a favorable recommendation to the City Council for the pre-zoning request for 144 acres.  The property is located at the northwest intersection of County Road 64 and County Road 54 West.  Currently the property is zoned RA in the County.  A legislative annexation is pending now in the Alabama legislature which could bring the property into city limits.  The developers are requesting a zoning change to R-6(G) for the 40 acres on the northeast side, and B-2(a) for the remaining 104 acres.
